Important Notice: Cognitive Well is a community wellness initiative championed by AppChurch Global Foundation, a 501(c)(3) nonprofit organization. These Terms govern your use of our website, events, screening programs, educational resources, and related services (the “Services”).

1. Acceptance of Terms

By accessing or using the Services, you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree, please do not use the Services.

2. Description of Services

Cognitive Well provides community-based education, early awareness screening events, caregiver support resources, and general wellness information focused on cognitive health and mild cognitive impairment (MCI). Our programs are designed to promote awareness and support healthy aging within communities.

The Services are not medical care. They do not constitute professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition.

3. Third-Party Services and Technologies

Cognitive Well collaborates with independent third-party providers for certain digital cognitive assessment and intervention tools. A primary collaborator is NoahTech, Corp. (“NoahTech”), a separate cognitive health technology company.

When you choose to use or are referred to third-party services (including but not limited to NoahTech apps, assessments, or platforms), you are subject to the terms, privacy policies, and practices of those third parties. Cognitive Well and AppChurch Global Foundation are not responsible for the content, accuracy, availability, or practices of third-party services.

Links to third-party applications (such as Memory Enhancement or Motor Function apps) and sign-up forms are provided for convenience only.

4. User Responsibilities

You agree to provide accurate information when participating in screenings or programs.
You understand that community screenings are for educational and awareness purposes and are not a substitute for a clinical diagnostic evaluation.
You will not use the Services for any unlawful purpose or in a manner that could damage, disable, or impair the Services.

5. No Warranties; Disclaimer

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.

Cognitive Well, AppChurch Global Foundation, and their directors, officers, employees, and agents make no representations or warranties regarding the accuracy, completeness, reliability, or usefulness of any information, screening results, or resources provided.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COGNITIVE WELL, APPCHURCH GLOBAL FOUNDATION, AND THEIR AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR USE OR INABILITY TO USE THE SERVICES; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY; OR (C) ANY CONTENT OBTAINED FROM THE SERVICES.

IN NO EVENT SHALL THE TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO COGNITIVE WELL (IF ANY) IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

7. Intellectual Property

All content on this site, including text, graphics, logos, and images (except third-party images used with permission), is the property of Cognitive Well, AppChurch Global Foundation, or its licensors and is protected by copyright and other laws.

8. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the State of New Jersey and applicable United States federal law, without regard to conflict of law principles. Any dispute shall be resolved exclusively in the state or federal courts located in New Jersey.

9. Changes to Terms

We may update these Terms from time to time. The “Last Updated” date reflects the most recent changes. Continued use of the Services after changes constitutes acceptance of the revised Terms.
